STANDARD TRADING CONDITIONS – FREIGHT FORWARDING – CLEARING SERVICES

1. Capacity

The Company acts solely as a freight forwarder and agent and not as a carrier. The Company arranges transportation

services through third party carriers on behalf of its customers.

2. Carriage

All carriage, storage and handling of goods is performed by third party carriers under their respective terms and

conditions, including applicable Bills of Lading.

3. Liability

The Company shall not be liable as a carrier. To the extent permitted by law, the Company shall not be responsible

for loss, damage or delay of goods arising from the performance of third-party carriers.

4. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable as carrier or otherwise for any loss,

damage or delay whatsoever. In the event that the Company is nevertheless found liable in any capacity, such

liability shall be strictly limited to the lowest limitation applicable under the terms of the relevant carrier.

5. Shipper Responsibilities

The shipper is responsible for proper packing, loading, stowage and preparation of the goods. The Company shall not

be liable for any consequences arising from improper loading or preparation.

6. Reefer / Temperature

Refrigerated containers are designed to maintain temperature of properly pre-conditioned cargo. The Company does

not guarantee temperature levels and shall not be responsible for temperature deviations or spoilage.

7. Equipment

Containers and equipment are supplied by third parties. The Company does not warrant their condition or suitability.

8. Delivery

Responsibility ceases upon delivery or release of the goods to the consignee or its representatives.

9. Time Limits

All claims are subject to the time limits contained in the applicable Bill of Lading.10. Indirect Loss

The Company shall not be liable for indirect or consequential loss, including loss of profit or market.

11. Insurance

Cargo insurance is not provided unless expressly agreed in writing.

12. Acceptance

By instructing the Company, the customer agrees to these Standard Trading Conditions.
